Free choice of Notary Public
According to Article 3 of the Spanish Decree of 2 June 1944, definitively approving the Regulations for the organization and regime of Notaries Public, Notaries Public, as a body of voluntary jurisdiction, shall never act without prior request from the interested party, except in particular cases required by law.
Thus, individuals have the right to freely choose a Notary Public without further limitations than those provided for in the legal system. As Notaries Public are public officials, this prevents the Public Administrations or the organizations or entities that depend on them can choose a Notary Public, according to the provisions of article 127 of these Regulations.
The provision of Notary Public services has obligatory nature provided that no legal reason or physical impossibility is preventing it.
Notarial jurisdiction, outside of authorisation cases, extends exclusively to the Notarial District in which the Notary Office is located.
