What is a Power of Attorney?

The General Council of Spanish Notaries Public defines powers of attorney as a public document that has been authorised by a Notary Public that empowers one person to appoint another as their representative.

In this way, the ‘proxy’ can act on behalf of the represented person (grantor) in certain legal acts.

For the benefit of citizens with Spanish nationality and foreigners residing in Spain, powers of attorney have legal validity in international territories.

Types of Powers of Attorney.

General power of attorney: the attorney will act on behalf of the grantor of the power in different legal acts, for example, lawsuits, administration of assets and general power of attorney, the latter grants very broad powers (purchase and sale of real estate).

Special powers of attorney: the proxy has powers for a specific legal act, for example, marriages, purchasing or selling property, making a transfer or accepting an inheritance.
