A marriage file is the set of procedures that must be conducted before the solemnisation of a marriage and that, bearing in mind the transcendence of the legal act to be performed, are absolutely essential to value the suitability of the intending spouses.

According to article 56 of the Spanish Civil Code, submitting this document is required to get married: “Those who wish to get married shall previously prove, in the record or file processed in accordance with the Register Office Regulations, that they meet the requirements of capacity or the absence of obstacles or their waiver”.

What is exactly a marriage file?

It is a voluntary jurisdiction file whose result is a document empowering two people to get married. For this purpose, firstly it must be checked that the couple meets the essential requirements to get married.

Likewise, it is verified that there is no obstacle to getting married or if it is a fake one.

Who can process it?

The competence is currently held, among others, by the Notaries Public. The Notary Public shall also register the property system of the intending spouses and the determination of their civil neighbourhood in the file.

First, you should go to the closest Official Association of Notaries Public to your home. The Official Associations are organised by Regions, and there may be one or more headquarters.
