Donations
Documenting Donations.
Donations consist in documenting the transfer of personal properties or real estate owned by the donor and transferred to another person.
The donee receives a particular asset free of charge and without the intervention of commercial exchange or payment of any amount of money.
Tax Advantages of Donations.
This procedure is characterised by its tax advantages that require formalisation through a public deed before a Notary Public. Normally these types of donations are made from parents to children, or between spouses, in which real estate can be donated as well as donations of money for the purchase of real estate by the donees.
Likewise, among the personal properties that this legal procedure allows is the donation of shares, vehicles and not-corporate shares of legal entities.
Types of Donations.
It should be noted that there are two main types of donations: non-collatable and collatable donations.
In principle, all donations are collatable unless the donor expressly provides otherwise, which means that the donee shall be obliged to compute it in their lot when they receive the inheritance.
It will be considered a NON-collatable donation when the donee receives it without entailing this obligation.
